Employing People with Disabilities: It's Easier than You Think!
by Job Accommodation Network (JAN)

On December 9th, 2011, the Office of Federal Contract Compliance Programs (OFCCP) issued proposed changes to existing regulations for Section 503 of the Rehabilitation Act of 1973. If the proposed regulations become final, they will create new obligations for federal contractors to employ people with disabilities. On the surface, employing people with disabilities may seem difficult, but in reality it is easier than you might think. In most cases, you just need to tweak your usual policies and procedures for finding and employing talented workers. read more

Using Applicant Reports to Help Your Company During an OFCCP Review
by Bill Osterndorf

It's a different world out there for companies going through OFCCP reviews. The U.S. Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) is in a much changed mode from its approach of several years ago. OFCCP is now heavily focused on issues concerning veterans and persons with disabilities. Much of the focus concerning veterans and persons with disabilities is centered on the outreach efforts that companies are making to find and hire members of these protected classes and the documentation that companies have to demonstrate this outreach. read more

Three Challenges in Detecting Bias in Promotion Activity
by Sandra Zeigler, Esq.

Detecting bias in promotion activity can be challenging. From an enforcement perspective, promotion discrimination is difficult to fit into a systemic framework which makes it hard to get the "bang for the buck" enforcement OFCCP prefers. From a compliance perspective, there are the challenges of defining the promotion pools for purposes of analysis and of understanding how to measure the promotion candidates against each other. Each of these challenges is discussed below. read more

The Fox OFCCP Report
by John Fox, Esq.

OFCCP is now monthly changing its audit processes. While OFCCP's audit tone is changing (to become more directive, more wooden, more demanding, and more strident--causing many (very many) contractors to now ruefully label OFCCP a "Bully"), the substance of OFCCP audits is also changing. With a Presidential election nearing, OFCCP has "gone Ollie North": i.e. OFCCP now just does what it has the physical power to do, regardless whether it has the legal authority to do it. Said another way, OFCCP is just "jamming it through", while relying on contractor cooperation and goodwill to permit the agency to run roughshod over good-natured contractors. read more
